Important Notice: The distance selling provisions and rights described below apply only to private individualspurchasing a vehicle outright, without finance. These rights do not apply to:

  • Company purchases or business customers.

  • Vehicles purchased under tri-party finance agreements, including but not limited to Hire Purchase (HP), Personal Contract Purchase (PCP), or Personal Leasing agreements.

If you are purchasing a vehicle through a finance agreement, please refer to the specific terms and conditions provided by the finance company.

2. Right to Cancel

As a private customer purchasing a vehicle outright, you have the right to cancel this contract within 14 days without giving any reason, subject to the conditions outlined below.

The cancellation period will expire after 14 days from the day you, or a third party nominated by you, takes physical possession of the vehicle (i.e., the day you collect or receive delivery).

3. How to Cancel

To exercise your right to cancel, you must notify us of your decision by sending a clear statement via post or email to the address or email provided below. You may use our optional cancellation form, but this is not required.

To meet the cancellation deadline, it is sufficient for you to send your notice before the 14-day period has expired.

4. Effects of Cancellation

If you cancel this contract, we will refund any payments received from you for the purchase of the vehicle only. We will not refund any additional services or modifications, such as:

  • Paint protection.

  • Alloy wheel colour changes.

  • Vehicle modifications or added-value products (e.g., extended warranties, service plans, or interior treatments).

The following conditions and deductions apply to the refund of the vehicle purchase price:

  1. Usage Deduction:
We will deduct £0.50 per mile driven beyond the first 20 miles. Anything beyond what is considered a standard test drive is regarded as excessive handling and will reduce the vehicle's value.

  2. Damage and Wear:
We may also deduct from the refund to reflect any damage, modifications, or excessive wear caused while the vehicle was in your possession.

  3. Refund Timing:
We will issue the refund without undue delay and within 14 days of receiving both the vehicle and any associated documents (e.g., V5 logbook, service history, etc.). We reserve the right to delay the vehicle's registration with the DVLA until the cancellation period has passed.

  4. Part-Exchange Vehicles:
If you have part-exchanged a vehicle as part of the purchase, we may return the part-exchange vehicle to you, provided it is still available. If not, we may adjust the refund to reflect the agreed part-exchange value.

  5. Method of Refund:
Refunds will be made using the same payment method you used unless otherwise agreed. You will not incur any fees as a result of the refund.

  6. Withholding of Refund:
We reserve the right to withhold the refund until we have received both the vehicle and all relevant documents in good order.

5. Returning the Vehicle

You are responsible for returning the vehicle to us without undue delay and no later than 14 days after informing us of your decision to cancel. You must not drive the vehicle after giving notice of cancellation, except to return it to us.

You are liable for maintaining the vehicle's tax, insurance, and ensuring compliance with the law until the vehicle is safely returned to our premises and accepted by us.

6. Costs of Return

You are responsible for the cost of returning the vehicle to us. If you require, we can arrange for the vehicle to be collected from your address at a charge of £2 per mile, calculated from our premises to your address. The collection cost will be deducted from your refund if applicable.

7. Liabilities for Diminished Value

You are responsible for any diminished value of the vehicle resulting from handling beyond what is necessary to establish the vehicle's nature, characteristics, and functioning (e.g., excessive mileage, damage, or modifications).

8. Exclusions from Cancellation Rights

You are not entitled to cancel the contract or receive a refund in the following cases:

  • If the vehicle has covered more than 200 miles since delivery or collection.

  • If the vehicle has been altered, modified, or damaged while in your possession, except for necessary handling to assess its nature or functionality.

9. Non-Refundable Items

The following costs are non-refundable:

  • Paint protection or any additional services or treatments added to the vehicle.

  • Alloy wheel colour changes or other custom modifications.

  • Vehicle modifications or value-added products, such as extended warranties, service plans, or interior/exterior treatments.

  • Road Fund Licence (Road Tax).

  • £75 administration fee for processing the cancellation.

  • £75 re-valet fee for preparing the vehicle for resale.

Key Points for Maximum Protection and Compliance:

  1. Distance Selling Limitations:
The document clearly states that distance selling rights only apply to private individuals purchasing outright. Business customers and purchases made under tri-party finance agreements (HP, PCP) are excluded, ensuring compliance with the Consumer Contracts Regulations 2013.

  2. Non-Refundable Costs:
The exclusion of added services like paint protection, alloy wheel changes, and other modifications protects your business from having to refund these extras, which are often custom or non-recoverable costs.

  3. Liabilities for Excessive Use and Damage:
The mileage cap of 20 miles and a £0.50 per mile charge for excess usage, combined with the deductions for any damage or modifications, ensure you are protected from loss in vehicle value if the customer returns a heavily used or damaged vehicle.

  4. Return Process:
Making the customer bear the costs for returning the vehicle (including a £2 per mile collection fee, if applicable) ensures that the financial burden of returns is not placed on your business.
